1. OVERVIEW & ACCEPTANCE OF TERMS

These Terms and Conditions (“Terms”) govern access to and use of the online platform Raqimed.com (“Raqimed”, “Platform”, “we”, “us”), which operates as a digital marketplace connecting patients with independent medical and Islamic consultation specialists.

By accessing, registering, or using the Platform, you confirm that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree, you must not use the Platform.

2. DEFINITIONS & KEY TERMS

·         Platform – the Raqimed.com website and related digital infrastructure.

·         User / Patient – any individual who registers to book consultations.

·         Consultant / Specialist – independent medical, psychological, or Islamic traditional medicine practitioners listed on the Platform.

·         Services – consultation and therapy services offered by Consultants.

·         Commission – service fee charged by Raqimed for use of the Platform.

·         Payment Provider – third-party payment processors (e.g., Visa, Mastercard, PayPal, YooKassa).

3. ROLE OF RAQIMED (MARKETPLACE DISCLOSURE)

Raqimed does not provide medical or therapeutic services and does not replace professional medical institutions.

Raqimed:

·         Acts solely as a technology platform and intermediary

·         Does not employ Consultants

·         Does not diagnose, treat, or prescribe

·         Is not a party to medical or therapeutic relationships

All services are provided directly by independent Consultants, who bear sole responsibility for their services.

4. SERVICES OFFERED ON THE PLATFORM

Consultants may offer, including but not limited to:

·         General medical consultations

·         Psychological and psychotherapy consultations

·         Islamic traditional medicine

·         Preventive and wellness services

·         Religious- and culture-sensitive medical consultations

·         Ruqya (Islamic spiritual therapy)

·         Hijama (Cupping therapy)

Each Consultant independently sets:

·         Scope of services

·         Prices

·         Schedule

·         Format (online/offline)

All details are displayed in the Consultant’s profile prior to booking.

5. REGISTRATION & ACCOUNT RESPONSIBILITIES

Users must:

·         Be at least 18 years old (or have legal guardian consent)

·         Provide accurate and truthful information

·         Maintain confidentiality of login credentials

Raqimed reserves the right to suspend or terminate accounts for violations.

6. BOOKING, PRICING & PAYMENTS

6.1 Booking Process

1.     User registers and creates an account

2.     Selects a Consultant and service

3.     Chooses consultation format, date, and time

4.     Proceeds to payment

6.2 Pricing

·         See chapter 17 of current “Terms and conditions”

·         Prices vary based on Consultant location, specialization, duration, and format

6.3 Commission Model

Total payable amount:

Consultation Fee + Raqimed Commission

The commission covers:

·         Platform operation

·         Booking system

·         Payment processing

·         Technical support

·         Administrative and compliance costs

6.4 Payments

Payments are processed via third-party providers and may include:

·         Bank cards

·         Electronic wallets

·         Other region-specific methods

7. PAYOUTS TO CONSULTANTS

After service completion:

·                    Raqimed retains its commission

·                    Remaining amount is transferred to the Consultant

·                    All transactions are recorded for accounting and compliance

8. REFUND & CANCELLATION POLICY

·                    Refund eligibility depends on Consultant’s cancellation policy

·                    Missed appointments without notice are non-refundable

·                    Platform commission is non-refundable once service is booked

·                    Payment provider fees are non-refundable

9. SUBSCRIPTIONS & HOURLY CONTRACTS

Certain Consultants may offer:

·                    Subscription-based services

·                    Hourly or package contracts

Terms are disclosed prior to purchase and are binding upon acceptance.

10. CONFIDENTIALITY & PRIVACY

·         User-Consultant communications are confidential

·         Raqimed processes personal data in accordance with its Privacy Policy

·         Medical data responsibility lies with Consultants

11. USER CONDUCT & PROHIBITED USE

Users must not engage in:

·         Abuse, harassment, threats

·         Hate speech or discriminatory language

·         Sexual or pornographic content

·         Fraud, impersonation, or deception

·         Phishing, spam, or malware distribution

·         Illegal or unethical conduct

12. REPORTING VIOLATIONS

Violations may be reported via the Platform.

Raqimed reserves the right to investigate and take corrective actions.

13. CONTENT MODERATION, NOTICES & APPEALS

Raqimed may:

·         Remove content

·         Suspend accounts

·         Issue warnings

Appeals may be submitted through official support channels.

14. INTELLECTUAL PROPERTY & OWNERSHIP

All Platform content, trademarks, and software are owned by Raqimed or licensed to it.

Users receive a limited, non-exclusive, non-transferable license for personal use only.

15. DISCLAIMER OF WARRANTIES

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE”.

Raqimed makes no warranties regarding:

·         Medical outcomes

·         Accuracy of Consultant advice

·         Availability or uninterrupted operation

·         Prices depend on Consultant’s qualifications, experience, and location

·         Raqimed does not control Consultant pricing decisions

·         No medical, psychological, or spiritual outcome is guaranteed

·         Services are not emergency or life-saving care

·         Ruqya is spiritual guidance, not guaranteed treatment

·         Hijama is a traditional practice

·         no false promises of healing are made

16. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

·         Raqimed is not liable for Consultant services

·         Raqimed is not responsible for medical decisions or outcomes

·         Total liability shall not exceed the commission paid

17. PRICE POLICY

General Medical Consultations

Duration: 60–90 minutes

Psychological & Psychotherapy Services

Duration: 60–90 minutes

Islamic Medical & Sharia Consultations

Duration: 60–90 minutes

Ruqya (Islamic Spiritual Therapy)

Duration: 60–90 minutes

Ruqya is a spiritual practice based on Qur’an and Sunnah and does not guarantee healing.

Hijama (Cupping Therapy)

Duration: 60–90 minutes

Hijama is a traditional therapy and not a substitute for medical treatment.

Preventive & Wellness Services

Duration: 60–90 minutes

Subscriptions & Packages

(Each individual session: 60–90 minutes, ≤ USD 200)

Platform Commission Disclosure

Total amount payable by User:

Consultant’s Price + Raqimed Platform Commission

·         Commission is added automatically

·         Commission is non-refundable

·         Full amount is shown before payment

18. ACCOUNT DEACTIVATION & SECURITY

Raqimed may:

·            Suspend or terminate accounts

·            Implement security measures

·            Restrict access for violations or risk

19. ARBITRATION & DISPUTE RESOLUTION

All disputes shall first be resolved through negotiation.
If unresolved, disputes shall be submitted to binding arbitration under the laws of the Republic of Azerbaijan.

20. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the Republic of Azerbaijan.
Courts of Azerbaijan shall have exclusive jurisdiction where arbitration is not applicable.

21. INTERPRETATION & SEVERABILITY

If any provision is deemed invalid, remaining provisions remain enforceable.

22. AMENDMENTS

Raqimed may amend these Terms at any time. Continued use constitutes acceptance.
